Dierbergs Receives Warning for Underage Tobbacco Sale

The Mackenzie Pointe supermarket was found in violation of federal regulations during a compliance check earlier this summer.

The Dierbergs Supermarket on Mackenzie Pointe has received a warning from the Federal Drug Administration for selling tobacco products to a minor.

According to a letter from the FDA dated Sept. 15, an underage individual purchased a pack of Marlboro cigarettes at the store during a June 2 compliance check. The letter further stated that the Dierbergs employee conducting the sale failed to ask for photographic identification to verify the individual’s age.  

The warning letter stated that Dierbergs should move immediately to correct these violations or be faced with regulatory action, which could include a monetary penalty, no-tobacco-sale order and/or injunction. It asked that the company submit a letter within 15 days of received the notice explaining its plans to stop such illegal sales.

The FDA randomly conducts compliance checks across the nation throughout the year and Dierbergs was not the only St. Louis-area establishment to be found in violation recently. Two Kirkwood gas stations located on Manchester Road, Waterway Carwash and Mobil Mart, and Long Station in Chesterfield also received warning letters for incidents that took place earlier this summer.
